Terms of Use for SUUMO

Article 1. Application of terms
1. SUUMO Terms of Use (hereinafter referred to as “these Terms”) shall apply to all users using “SUUMO,” a comprehensive information website on real estate and housing (hereinafter referred to as “the Site” and shall include all services provided on the site) operated by Recruit Co., Ltd. Co., Ltd. (hereinafter referred to as “Recruit Co., Ltd.”), and users shall consent to these Terms before using the Site.
2. When there are warnings etc. indicated on the Site by Recruit Co., Ltd. (hereinafter referred to as “warnings etc.”), the warnings etc. shall constitute a part of these Terms.
3. Recruit Co., Ltd. deems that the user has consented to these Terms with use of this Site.
Article 2. Copyrights
1. Users shall not use any content provided through the Site beyond the scope of private use by an individual user specified by the Copyright Act without prior consent from Recruit Co., Ltd..
2. In the event that a dispute arises due to violation of the terms of this Article, the user shall resolve said dispute at his/her own expense and responsibility, and shall not inflict any damage upon Recruit Co., Ltd. or a third party.
Article 3. Acts Prohibited for User
1. When using this site, users must not engage in the following.
  • (1)Acts of using the services, provided by Recruit Co., Ltd. on the Site, with illegal purposes;
  • (2)Acts of infringing on the copyrights, image rights, or other intellectual property rights of other users or any third party;
  • (3)Acts discriminating against, defaming, or threatening other users or any third party or violating the privacy or human rights or the like of other users or any third party:
  • (4)Acts of engaging in political activities, election campaigning, or religious activities;
  • (5)Acts damaging the honor, reputation or credibility of Recruit Co., Ltd.;
  • (6)Acts impeding the operation of the Site;
  • (7)Acts of using the Site for any commercial purpose (excluding the cases where Recruit Co., Ltd. permits the same);
  • (8)Other acts which violate or which may violate laws, ordinances, or public order and morality;
  • (9)Other acts which are deemed to be inappropriate or improper by Recruit Co., Ltd..
2. If any of the foregoing acts set forth in the preceding paragraph causes any damage to Recruit Co., Ltd. or any third party, the relevant user shall assume all the legal liability therefor and shall hold Recruit Co., Ltd. and any third party harmless from any damage.
3. If Recruit Co., Ltd. reasonably determines that a user is or has been engaged in any of the acts set forth in the two preceding paragraphs, Recruit Co., Ltd. can discontinue the use of the Site by the relevant user without prior notice.
Article 4. Prohibition of relations with antisocial forces
1. Recruit Co., Ltd. and user represents and provides his/her assurance that, both at present and in the future, he/she is not and will not become a crime syndicate, a crime syndicate member, a person for whom five years have not yet passed after ceasing to be a crime syndicate member, an associate member of a crime syndicate, a corporation associated with a crime syndicate, a sokaiya (corporate racketeer), a political racketeer advocating social change, a special white-collar criminal group, etc., or other persons similar to any of the foregoing (collectively, “Crime Syndicate Member(s)”); and that none of the following applies or will apply to Recruit Co., Ltd. or user:
  • (1)A relationship under which an Organized Crime Group Member is recognized as having control over users’ management;
  • (2)A relationship under which an Organized Crime Group Member is recognized as being substantially involved in users’ management;
  • (3)A relationship under which users are recognized as using an Organized Crime Group Member for purposes such as obtaining illicit gains on users’ behalf or on behalf of a third party, or causing damage to a third party;
  • (4)A relationship under which users are recognized as being involved with an Organized Crime Group Member, such as providing an Organized Crime Group Member with funds, convenience or benefits; or
  • (5)A socially-condemnable relationship between any officer or person substantially involved in users’ management and an Organized Crime Group Member.
2. Recruit Co., Ltd. and users promise that they will not either directly or through a third party, commit against Recruit Co., Ltd. any act falling under any of the following items:
  • (1)Making any demand through violent means;
  • (2)Making any unfair demand beyond the legal liability concerned;
  • (3)Making or engaging in any intimidating statements or behavior, or practicing violence in relation to transactions;
  • (4)Damaging the credibility of the other party by spreading rumors or using fraudulent means or force, or otherwise obstructing the business activities of the other party; or
  • (5)Any act similar to any of the foregoing.
3. In the event that the other party is discovered to be, contrary to the declaration in accordance with the preceding two paragraphs, a member of an organized crime group or to fall under any of the items listed in the preceding two paragraphs, Recruit Co., Ltd. or the user may cancel all agreements based on these Terms without notice, and the other party shall not raise any objections. In this case, the party violating the declaration shall lose the benefit of time, and shall immediately redeem the claims to the other party.
Article 5. Document request service
When a document request service is operated on the Site, unless otherwise specified, document request service refers to the service in which the user makes a request through the Site to a business entity taking part in the Site (hereinafter referred to as “Entity”) for documents and Recruit Co., Ltd. forwards said requested contents to said Entity.
Article 6. Provision of information
Note that, for all services of the Site, Recruit Co., Ltd. may receive from an Entity, information on agreement conclusion statuses between the Entity and the user.
Article 7. Rules for posting and viewing reviews
1. When a service allowing users to post or view reviews on the Site (hereinafter, the posted information is referred to as “reviews”) is operated, rights such as copyrights etc. (including the rights of Article 27 and Article 28 of the Copyright Act) shall belong to Recruit Co., Ltd., and the user shall consent to not exercising moral rights or raising objections. A user posting a review consents to the fact that Recruit Co., Ltd. may post the review after modification or deletion in whole or in part, may not post the review, or may replicate, modify, post, publicly transmit, or allow use to third parties.
2. Users shall not post reviews that contain the following contents. In the event of violation, Recruit Co., Ltd. may, with its own judgment, modify or delete the review in whole or in part, or stop the user from posting to the Site.
  • (1)Content beyond the purposes of the information posting service covering reviews;
  • (2)Content that is not based on the user’s own experience;
  • (3)Posting for-profit content;
  • (4)Posting false content or content contrary to facts;
  • (5)Intentionally posting multiple entries with the same content;
  • (6)Content which Recruit Co., Ltd. deems is an issue between the user and the Entity;
  • (7)Content that infringes upon copyrights, trademarks, right of privacy, or rights of other parties such as defamation;
  • (8)Content that contains personal information;
  • (9) Content that contains commercial contents such as product introduction, solicitation of pyramid selling, etc.;
  • (10)Content that contains inappropriate language such as slander or discriminatory expressions;
  • (11)Content that contains obscene or explicit language;
  • (12)Content that may be considered to be an advertisement for information that could only arise under certain conditions;
  • (13)Content that is perceived as coercive or threatening others;
  • (14)Content that provokes or promotes violence, cruelty, or crimes;
  • (15)Content that falls under solicitation of inappropriate benefit to the shops listed on the Site or third parties or damage to credit;
  • (16)Content which violates legislation, public order or morality;
  • (17)Content that is nonsense or grotesque;
  • (18)Content that includes expressions such as “better not to use,” “absolutely should not,” “appalling,” or “worst quality” that Recruit Co., Ltd. deems to be arbitrary or assertive;
  • (19)Other content which Recruit Co., Ltd. deems inappropriate to be posted on the bulletin board;
3. In the event that a problem attributable to a review posted by a user arises between said user and Recruit Co., Ltd. or a third party, said user shall resolve said problem at his/her own responsibility, and cause Recruit Co., Ltd. no trouble.
4. Recruit Co., Ltd. shall not be liable for any damage caused by users posting reviews, unless Recruit Co., Ltd. is engaged intentionally or negligently.
5. When a user views reviews, the contents are posted under the responsibility of the user who posted the review, and Recruit Co., Ltd. does not guarantee the credibility, legality, safety, appropriateness, availability, etc. of the contents. In addition, Recruit Co., Ltd. does not guarantee that the content and language of reviews is free of incorrect information, unpleasant comments, messages lacking dignity, etc.
Article 8. Temporary Suspension
1. If any of the following occurs, Recruit Co., Ltd. may temporarily suspend the operation of the Site and the various services provided on the Site without prior notice to the users
  • (1) If there is any maintenance of the Site or change in the specifications;
  • (2)If any natural disaster or other emergency situation occurs or may occur, thereby disabling the operation of the Site and the various services;
  • (3) If Recruit Co., Ltd. considers that, due to unavoidable reasons, it is necessary to temporarily suspend the operation of the Site and the various services.
2. If any of the foregoing acts set forth in the preceding paragraph causes any damage to Recruit Co., Ltd. or any third party, the relevant user shall assume all the legal liability therefor and shall hold Recruit Co., Ltd. and any third party harmless from any damage.
3. If Recruit Co., Ltd. reasonably determines that a user is or has been engaged in any of the acts set forth in the two preceding paragraphs, Recruit Co., Ltd. can discontinue the use of the Site by the relevant user without prior notice.
Article 9. Recruit Co., Ltd.’ Disclaimer
1. Recruit Co., Ltd. shall not be responsible for investigating the business conditions of the business operators participating on the Site (“Business Operators”).
2. Recruit Co., Ltd. provides no guarantee whatsoever in regard to the accuracy, integrity, usefulness or the like of the information provided by the Business Operators posted on the Site. If the users have any troubles relating to such information, Recruit Co., Ltd. shall have no liability whatsoever unless such trouble is attributable to Recruit Co., Ltd..
3. Recruit Co., Ltd. shall have no liability whatsoever for any damage caused by suspension due to natural disasters, convergence of lines, failure of equipment, or maintenance; loss, delay, incorrect transmission of information due to termination of the Business Operators’ participation on the Site or the like; or alteration, leakage, or the like, of information by any third party, unless such damage is attributable to Recruit Co., Ltd.. The same shall apply to any accidents or other damage to software and hardware caused by the use of the Site.
4. Other than the provisions in each paragraph of this Article, Recruit Co., Ltd. shall have no liability whatsoever for any conflict between users and any third party caused by the use of the Site, unless such conflict is attributable to Recruit Co., Ltd..
Article 10. Amendment to Terms of Use
1. Recruit Co., Ltd. may amend these Terms of Use and the various Points to Take Note Of (including any additions thereto and deletions thereof; the same shall apply hereinafter) without prior notice to the users.
2. The amended Terms of Use and various Points to Take Note Of shall be deemed to have been approved at the time when users access and use the Site after such are posted on the Site.
Article 11. Handling of Personal Information
The handing of personal information on the Site shall be in accordance with the separately established privacy policy.
Article 12. Governing Law and Jurisdiction
  These Terms of Use shall be governed by the laws of Japan, and any dispute relating to these Terms of Use shall be exclusively submitted to the Tokyo District Court or the Tokyo Summary Court in the first instance.
Supplementary provisions
These Terms of Use shall take effect on March 4, 2009.
